  • The Promoter is URC Snack Foods (Malaysia) Sdn. Bhd., Registration Number:092670-W, A company duly incorporated in Malaysia and having its registered address at: No. 1, Jalan Jurunilai U1/20, Seksyen U1, Hicom Glenmarie Industrial Park, 40150 Shah Alam, Selangor (“Promoter”)

  • Participation in this Promotion is deemed acceptance of these terms and conditions.

CONDITIONS OF ENTRY:

  • This Promotion is only open to all residents of Malaysia aged 16 years old and above (as at the date of participation in this Campaign) with a valid MyKad (Participant), who purchase RM10 worth of Cloud 9 products, inclusive of Cloud 9 Wafret twins (Chocolate, Vanilla or Kaya Pandan flavour), within the same transaction (one single receipt), during the promotional period of 1st April 2022 to 31th May 2022, in participating stores.
  • All purchases can be made from select retail stores both online or offline.
  • Purchases made from e-commerce/websites that do not have a registered physical store are not eligible as they include both counterfeits and parallel imports which are out of Cloud 9’s responsibility.
  • This personal offer is limited to one valid participation per e-mail. Cloud 9 and TLC Marketing employees or their representatives cannot benefit from the offer. This promotion is available to consumer purchases and not B2B (including not limited to traders, distributors retailers and/or online retailers purchasing in bulk for commercial purposes).

KEY DATES:

  • The promotional period opens 12.01AM MY on 1st April 2022 and closes 11.59PM MY on 31th May 2022 (“Promotional Period”).
  • The participation period opens 12.01AM MY on 1st April 2022 and closes 11.59PM MY on 14th June 2022 (“Redemption Period”).

HOW TO PARTICIPATE:

  • Following their eligible purchase, consumers visit the promotion dedicated microsite https://cloud9rewards.com.
  • To participate in the promotion, consumers need to fill in the online participation form with their personal details: surname, first name, email address and phone number and upload the photo/scan of their proof of purchase (only photographs of original receipts issued by the participating stores and e-commerce site shall be accepted as proof of purchase), before the closure of the Redemption Period on 14th June 2022.
  • Proof of submission is not proof of receipt. The Promoter and TLC shall not be responsible or liable for any delay or non-receipts of submissions.
  • The Promoter and TLC shall have the sole discretion to disqualify or reject any submission deemed to be illegible, incomplete, which does not satisfy the conditions of the offer, or which are submitted after the deadline, will be considered as invalid. These applications will not be processed. Neither the Promotor nor TLC is obligated to contact any consumer who do not qualify for the redemption.
  • Upon successful submission, an email will be sent through to the consumer to acknowledge their redemption and will send through their rewards, within 5 working days following the submission date of the valid participation.
  • All Purchases are subject to verification and validation of the receipts as proof of purchase.

REWARDS - TERMS AND CONDITIONS

Valid participating consumers will receive:

  • 1 Free game up to 6 pax on The Virtual Escape Room, worth RM240. The cost of all additional requests not included in the offer (equipment, extended period, additional services, etc.) will be exclusively attributable to the consumer.
  • Consumers must respect general condition of each partner: The Virtual Escape Room. Partner websites reserve the right to modify their rates (if applicable).
  • Three partner code will be accepted by account by The Virtual Escape Game.
  • Entries are limited to three per person for the duration of the promotion.
  • Choice of partners has been the subject of great attention for their quality. Nevertheless, the Promoter and TLC Marketing shall not be held liable once the reservation has been made with one of the partners because of errors, partners of involuntary omissions for any reason or in the event of incidents.

MISCELLANEOUS

  • Customers must have made a qualifying purchase. Customers can be deemed invalid at the absolute discretion of the Promoter or TLC, resulting in invalidation of a Qualified Customer’s claim (and/or all claims submitted by the Qualified Customer) and forfeiture of any right to a Reward.
  • The Promoter and TLC reserve the right to request Qualified Customers to provide proof of identity in order to claim the Reward. Subject to the applicable laws, identification considered suitable for verification is at the discretion of TLC and the Promoter. In the event that a consumer cannot provide suitable proof, the Qualified Customer will forfeit the Reward in whole and no substitute will be offered.
  • Incomprehensible, indecipherable and incomplete entries may at TLC’s discretion be deemed invalid and not eligible for Reward.
  • The Promoter and TLC’s decision in relation to all aspects of this Promotion is final and no correspondence will be entered into.
  • The Reward is personal to each Qualified Customer, and cannot be exchanged, transferred, shared or assigned in any manner. Rewards cannot be used or redeemed in conjunction with any other Promotion.
  • Promotion is available online only and therefore access to the internet is required to participate in this Promotion. Any cost associated with accessing the promotional website is the claimant’s responsibility and is dependent on the Internet service provider used.
  • The Promoter (including its directors, officers, employees and agents) and TLC reserves the right, at any time, to verify the validity of claims and claimant (including a claimant’s identity, age and place of residence) and reserve the right, in their discretion, to disqualify any individuals who they have reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s and TLC’s discretion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  • Failure by the Promoter or TLC to enforce any of their rights at any stage does not constitute a waiver of those rights. The Promoter’s and TLC’s legal rights to recover damages or other compensation arising as a result of such conduct are reserved.
  • The Promoter (including its directors, officers, employees and agents), TLC, its respective agents, Reward providers and distributors are not liable for lost, stolen or damaged Rewards, and to the extent permitted by law do not make any contractual promise or representation regarding the quality and/or availability of the services offered and cannot be held liable for any resulting personal loss or damage.
  • The Promoter or TLC reserves the right to vary the terms of the Promotion at anytime and to withdraw the Promotion without notice.
  • In the event that for any reason whatsoever a Qualified Customer does not take or claim a Reward (or an element of a Reward) at or by the time stipulated then that Reward (or that element of the Reward) will be forfeited by the Qualified Customer and cash will not be awarded in lieu of that Reward (or element of the Reward).
  • Rewards have no monetary value and is not transferrable (for sale or resale). There shall be no cash refund, either partially or in full, and it may not be combined with any other promotional offer.
  • TLC Marketing reserves the right to cancel the offer or to substitute another offer of equal or greater value, without the consumer being able to claim other compensation, indemnities of any sort, or claim any cash awards.
  • Redemption of the Reward is on a “first come first serve”, “while stocks last” basis and redeemed on an “as is” basis. All warranties are excluded to the fullest extent possible.
  • Except for any liability that cannot be excluded by law, the Promoter (including its directors, officers, employees and agents), TLC and the Rewards providers (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
    • any technical difficulties or equipment malfunction (whether or not under the Promoter’s or TLC’s or Rewards provider’s control);
    • any theft, unauthorized access or third party interference;
    • any claim or Reward that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter or TLC or Rewards provider) due to any reason beyond the reasonable control of the Promoter or TLC or Rewards provider;
    • any variation in Reward value to that stated in these Terms and Conditions;
    • any tax liability incurred by a Qualified Customer or claimant; or
    • use and/or taking of a Reward.
  • Should a Qualified Customer’s contact details change during the Promotion, it is the Qualified Customer’s responsibility to notify TLC. A request to access or modify any information provided in claim/entry should be directed to TLC.
  • If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason, including by outside act, agent or event that is beyond the reasonable control of the Promoter and TLC, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter and TLC reserves the right, in their sole discretion, to the fullest extent permitted by law:
    • to disqualify any claimant; or
    • To shorten, extend, modify or cancel the operation in the event of unforeseen circumstances, as appropriate. It shall not be held liable by reason of these modifications. The terms of the Reward are as stated in these Terms & Conditions and no other representations (written or oral) shall apply. Nothing in these terms affects any statutory rights as a Qualified Customer may have. By participating in the promotion, consumers accept these Terms and Conditions.
  • Claimants consent to the Promoter and TLC using their name, likeness, image and/or voice in the event they are a successful Qualified Customer (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or TLC.
  • Personal data (PD) is being collected by TLC in order to administer and conduct this Promotion, including to contact Qualified Customers and to conduct verification and other actions in connection with this promotion for the administration of redemption items in relation to this Promotion. For this purpose, TLC may disclose PD to third parties, including but not limited to agents, contractors, service providers, suppliers and, as required, to regulatory authorities. Participation is conditional on providing this PD. TLC will use and handle personal information as set out in its Privacy Policy, which can be viewed at the privacy policy tab on this site.
  • Any intellectual property contained in any materials used in connection with this promotion and the redemption items is the property of their respective owners.
  • The terms and conditions of this promotion are governed by Malaysia law, and Participants of this promotion shall submit to exclusive jurisdiction of Malaysia courts.
